What constitutes a 'Competing Brand' according to The Standardx?

The_Standardx Franchise · 2025 FDD

Answer from 2025 FDD Document

We may refuse to approve a management company that is a Competing Brand Owner. "Competing Brand Owner" means any entity that (a) is either a franchisor or owner of a Competing Brand (defined below), (b) manages or otherwise operates hotels exclusively for the franchisor or owner of a Competing Brand, or (c) is an affiliate of any entity described in (a) or (b) above. A "Competing Brand" is a hotel concept that has at least 5 hotels operating under that concept's trade name anywhere in the world and that, in our reasonable opinion, competes with Brand Hotels.

What This Means (2025 FDD)

According to The Standardx's 2025 Franchise Disclosure Document, a 'Competing Brand' is defined as a hotel concept that meets specific criteria related to its size and competitive positioning. Specifically, a 'Competing Brand' must have at least five hotels operating under the same trade name anywhere in the world. Furthermore, The Standardx must reasonably consider that the hotel concept competes with Brand Hotels. This definition is important because The Standardx may refuse to approve a management company that is a 'Competing Brand Owner'.

The definition of 'Competing Brand Owner' extends beyond just the brand itself. It includes any entity that is either a franchisor or owner of a 'Competing Brand', manages hotels exclusively for a 'Competing Brand', or is an affiliate of such an entity. This broad definition aims to prevent conflicts of interest and ensure that management companies are fully committed to The Standardx's brand standards and success.

For a prospective franchisee, this definition has several implications. First, it restricts the franchisee's ability to use a management company that operates or is affiliated with a competing hotel brand. Second, it highlights the importance of understanding The Standardx's perspective on what constitutes a competitive threat. Franchisees should seek clarity from The Standardx regarding specific hotel brands that may be considered 'Competing Brands' to avoid potential conflicts or disapproval of their chosen management company.
