Answer from 2025 FDD Document

    1. Plans and Designs. You must submit to us your plans, layouts, specifications, and drawings for your Hotel (collectively, the "Plans"), and your plans, layouts, specifications, and drawings for the proposed furnishings, fixtures, equipment and décor of your Hotel (collectively, the "Designs") with respect to the Construction Work. We may supply you with representative prototype guest room and public area plans and schematic building plans as a guide for preparation of the Plans and Designs. Our approval of such Plans and Designs does not warrant the depth of our analysis or assume any responsibility for the efficacy of the Plans and Designs, or the resulting Construction Work. You acknowledge and agree that you will not rely upon any approval we may provide you for the Plans or Designs for any purpose whatsoever except compliance with our then prevailing Brand Standards.

What This Means (2025 FDD)

According to Sonesta Simply Suites's 2025 Franchise Disclosure Document, 'Plans' refer to the detailed plans, layouts, specifications, and drawings for the hotel itself. 'Designs' encompass the plans, layouts, specifications, and drawings for the proposed furnishings, fixtures, equipment, and décor of the hotel. These Plans and Designs are specifically related to the Construction Work or Renovation Work required for the Sonesta Simply Suites hotel.

As a prospective franchisee, you are required to submit both the Plans and Designs to Sonesta Simply Suites for their approval. The franchisor may provide prototype guest room plans, public area plans, and schematic building plans to guide you in preparing your own Plans and Designs. However, the FDD clearly states that Sonesta Simply Suites's approval of these Plans and Designs does not guarantee their effectiveness or assume responsibility for the outcome of the Construction or Renovation Work.

The franchisee is responsible for ensuring that the hotel and all Construction Work comply with all applicable laws, regulations, and requirements. While Sonesta Simply Suites has the right to participate in progress meetings and inspect the hotel during construction, this does not imply any representation of the adequacy of the construction or the structural integrity of the hotel. Therefore, it is crucial for a franchisee to engage qualified professional advisors to ensure compliance and the successful completion of the project.
