What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, Sonesta Select Sonesta Essential includes the franchisee's notice address to ensure that official communications are delivered to the correct location. This address, which cannot be a P.O. Box, is used for any formal notices required under the Franchise Agreement. This ensures that the franchisee receives important legal and contractual information.
According to Section 18 of the franchise agreement, notices must be sent via Registered or Certified Mail, Return Receipt Requested, with postage prepaid. If Sonesta Select Sonesta Essential needs to send a formal notice to a franchisee, it will use the address specified on Exhibit A or the franchisee's hotel address. Similarly, the franchisee must use Sonesta Select Sonesta Essential's address, as listed in the introductory paragraph of the agreement, when sending notices to the franchisor.
This process is designed to provide a verifiable method for sending and receiving important communications, reducing the risk of disputes over whether a notice was properly delivered. However, day-to-day communications can be conducted via email, as agreed upon by both parties. This dual approach allows for both formal, trackable notifications and efficient, routine correspondence.
