According to Sonesta Select Sonesta Essential's 2025 Franchise Disclosure Document, the term 'Marks' encompasses a comprehensive range of identifiers associated with the brand's hotels and services. This includes not only the service marks and trademarks themselves, such as 'Sonesta Select® Hotels' and 'Sonesta Essential® Hotels,' but also related logos, insignia, emblems, symbols, designs, slogans, distinguishing characteristics, and trade names. Essentially, 'Marks' covers any intellectual property rights that Sonesta Select Sonesta Essential designates for use in connection with its Brand Hotels.
For a prospective franchisee, understanding the scope of the 'Marks' is crucial because it defines the branding elements they are authorized to use and the visual identity they must maintain. This ensures consistency across all Sonesta Select Sonesta Essential locations and reinforces brand recognition among customers. The franchise agreement will specify which 'Marks' the franchisee is permitted to use, and adherence to these guidelines is typically a key requirement for maintaining the franchise.
The definition of 'Marks' also highlights the importance of intellectual property protection for Sonesta Select Sonesta Essential. Franchisees benefit from this protection as it helps to maintain the value and reputation of the Sonesta Select Sonesta Essential brand.
It is important for potential franchisees to review the franchise agreement carefully to fully understand the specific 'Marks' they are authorized to use and any restrictions or guidelines associated with their use.
