Review and approve your plans, layouts, specifications, and drawings for your Hotel (the "Plans") and your plans, layouts, specifications and drawings for the proposed furnishings, fixtures, equipment, and décor of your Hotel (the "Designs"), at our election. You are responsible for ensuring your Plans and Designs comply with all applicable laws, rules, permits, licenses, and other governmental requirements. What This Means (2025 FDD)
According to Sonesta Select Sonesta Essential's 2025 Franchise Disclosure Document, the franchisee is responsible for ensuring that the Plans and Designs for their hotel comply with all applicable laws, rules, permits, licenses, and other governmental requirements. Sonesta Select Sonesta Essential may review and approve the franchisee's plans, layouts, specifications, and drawings for the hotel, as well as the proposed furnishings, fixtures, equipment, and décor, but this is at their discretion.
Prior to construction, franchisees must obtain all necessary insurance, including builder's risk, and all permits and certifications required for lawful construction of the hotel, including zoning, access, sign, and building permits, consents, and licenses. Franchisees must also submit their Plans and Designs with respect to any Renovation Work or Construction Work to Sonesta Select Sonesta Essential.
Sonesta Select Sonesta Essential may supply representative prototype guest room and public area plans and schematic building plans as a guide for preparation of the Plans and Designs. However, Sonesta Select Sonesta Essential's approval of such Plans and Designs does not warrant the depth of their analysis or assume any responsibility for the efficacy of the Plans and Designs, or the resulting Renovation Work or Construction Work. All legal compliance with respect to the Renovation Work or Construction Work, and Plans and Designs are the franchisee's responsibility.
This means that while Sonesta Select Sonesta Essential may offer guidance and review plans, the ultimate responsibility for ensuring the hotel's design and construction adheres to all legal and regulatory requirements falls on the franchisee. This includes compliance with local, state, and federal laws, including obligations imposed by the Americans with Disabilities Act.
