All reports and records or other information including but not limited to client information supplied to REMAX, LLC or us pursuant to Section 10 shall be considered our or REMAX, LLC's property and no such information shall be considered confidential. Subject to state laws that may be applicable, REMAX, LLC and REMAX Regional shall have the right to use, share, aggregate with other franchise information, disclose and sell all information (aggregated or not), including client information, derived from what you supply for our own business purposes and to profit from that information without providing any compensation to you.

What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, certain information provided to or accessed by Remax is not considered confidential and becomes the property of Remax. Specifically, information generated, uploaded, or transferred to MAX/Center and the BoldTrail Back Office Software, as well as information stored in the integrated Intuit QuickBooks Online account, is not considered confidential. Remax has the right to access, use, analyze, and take action on this information for various purposes, including compliance monitoring, analysis, technical support, and system improvement.
Similarly, information generated, uploaded, or stored on Optional Resources is not considered confidential. Remax can access, evaluate, use, and analyze this data for purposes such as gathering information, generating insights, providing technical support, and improving the Remax system. Remax may also sell and monetize this information, including client information, without compensating the franchisee. All reports, records, and other information, including client information, supplied to Remax are also not considered confidential. Remax has the right to use, share, aggregate, disclose, and sell all information derived from what the franchisee supplies for its own business purposes and to profit from that information without compensating the franchisee.
This has significant implications for a prospective Remax franchisee. The franchisee should be aware that a wide range of data they generate or provide through Remax systems and optional resources is accessible to Remax, is not considered confidential, and can be used for Remax's benefit, including potential monetization, without compensation to the franchisee. This includes client information, which is a critical asset for any real estate business. Franchisees should carefully consider the extent to which they are comfortable with this level of access and use of their data by Remax.
