What This Means (2025 FDD)
According to the 2025 Remax Franchise Disclosure Document, franchisees are prohibited from divulging Confidential Information to any other person after the transfer, termination, or expiration of the Franchise Agreement, or after abandonment of the office, without prior written consent from Remax. Confidential Information includes, but is not limited to, confidential matters, trade secrets, recruiting techniques, accounting procedures, quality control procedures and other methods developed by REMAX, LLC as part of the System.
This obligation extends beyond the term of the agreement, emphasizing the importance Remax places on protecting its proprietary information. Franchisees must also ensure that their employees and independent contractors who have access to Confidential Information also comply with these restrictions.
This clause is typical in franchise agreements to protect the franchisor's business methods and trade secrets. Prospective Remax franchisees should understand that this confidentiality obligation is a significant and ongoing responsibility.
