What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, franchisees must take necessary steps, at their own expense, to protect the Confidential Information associated with operating their Remax office. This includes not divulging any Confidential Information to any person during the term of the agreement or after its transfer, termination, or expiration, without Remax's prior written consent. Franchisees also have to ensure that their employees and independent contractors who have access to Confidential Information comply with these restrictions.
Confidential Information includes confidential matters, trade secrets, recruiting techniques, accounting procedures, quality control procedures, and other methods developed by Remax as part of the System. This information is considered essential to the operation of the franchise, enabling franchisees to operate efficiently, effectively, and profitably. The Confidential Information includes information received at the Initial Education Program, information shared through System communications, and meetings and discussions with Remax representatives.
This obligation extends beyond the active term of the franchise agreement, meaning that even after the agreement expires or is terminated, the franchisee is still responsible for maintaining the confidentiality of the information. This continuing obligation highlights the importance Remax places on protecting its proprietary information and maintaining a competitive advantage in the real estate market. Franchisees should budget for these protection measures and ensure that all staff and contractors are aware of and adhere to these confidentiality requirements.
