ich Contractor conducts Contractor's day-to-day real estate activities as an independent contractor on behalf of Broker.

  • K. Compliance with Laws and Good Business Practices. Contractor shall abide by all applicable laws, ordinances and regulations including, without limitation, local, state and federal laws and regulations relating to real estate transactions and real estate service businesses; data security and protection of privacy and personal information (including but not limited to the use, storage, transmission, and disposal of data regardless of media type); and antisolicitation laws regulating phone calls, texting, spamming, and faxing (including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act, and the Telemarketing Sales Rule). Contractor's advertising, marketing and promotion must be completely factual and conform to the highest standards of lawful, ethical advertising. In all dealings with clients, customers, suppliers, public officials, other real estate agents and brokers and the general public, Contractor must adhere to the highest standards of business behavior, honesty, integrity, fair dealing and ethical conduct. Contractor agrees to refrain from any business or advertising or marketing practice which may expose Broker to legal action or liability or adversely affect the reputation or image of Broker, other RE/MAX offices or RE/MAX affiliates, the RE/MAX Network, REMAX, LLC or the goodwill associated with the RE/MAX Marks.
  • L. Loyalty. At all times during the term of this Agreement, Contractor shall act under a duty of loyalty in support and in furtherance of the RE/MAX System and RE/MAX Network and shall maintain a proper attitude toward the public, Broker and Contractor's fellow RE/MAX Sales Associates.

Furthermore, Remax requires that all marketing and promotion, including that of Sales Associates, must be completely factual and conform to the highest standards of ethical advertising. Franchisees must also respond promptly to all complaints received from customers, clients, or other individuals in an attempt to resolve any disputes in a reasonable business manner. They must also ensure that their Sales Associates and any other persons affiliated with their Office refrain from any business or advertising practice which may be injurious to Remax's business and the goodwill associated with the Remax Marks and other Remax offices.

These standards are designed to protect the Remax brand and ensure that all franchisees and contractors operate with integrity and professionalism. Failure to adhere to these standards could result in legal action, damage to the Remax brand, or termination of the franchise agreement.
