What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, Remax is not responsible for the accuracy or completeness of BoldTrail data. The BoldTrail Platform Agreement outlines that all offerings, including BoldTrail Data, are provided "AS IS," and the Licensor (Inside Real Estate) disclaims all warranties, whether express, implied, or statutory.
Specifically, the agreement states that the Licensor makes no warranty that any BoldTrail Data will be accurate or complete. This means a Remax franchisee cannot hold the Licensor liable for any inaccuracies or omissions in the data provided through the BoldTrail platform. The franchisee bears the risk of relying on the data and should take appropriate measures to verify its accuracy if necessary.
This disclaimer is a significant consideration for prospective Remax franchisees, as BoldTrail is the required Back Office Software. Franchisees should understand that the data they receive through this platform, which is used for reporting and enhancing office operations, comes without any guarantee of accuracy or completeness. This could impact decision-making and reporting obligations, so franchisees should factor this risk into their business planning and due diligence.
