What is the requirement for Remax clients to use the content provided by the vendor?

Member agrees that unless instructed otherwise by the client, Member will give any authority, consent or instructions required, and otherwise use Member's best efforts, to ensure that all of Member's real estate listings, including those of Member's Sales Associates (Your "Office Listings"), are made available to RE/MAX and that, unless instructed otherwise by the client, neither Member nor Member's Sales Associates will decline, or opt out of, any opportunity to have any Office Listing provided or forwarded to RE/MAX.
Member hereby grants to RE/MAX a non-exclusive, irrevocable, worldwide, royalty free license to use, sublicense through multiple tiers, copy, publish, display, and reproduce the Listing Content contained in Member's Office Listings, to prepare derivative works of the Listing Content, and to distribute the Listing Content or any derivative works thereof. As used herein, "Listing Content" means all data and content, including without limitation, all photographs, images, graphics, video recordings, virtual tours, drawings, written descriptions, remarks, narratives, and pricing information with respect to an Office

What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, franchisees must exert their best efforts to ensure all real estate listings are made available to Remax, unless the client instructs otherwise. This obligation extends to the franchisee's sales associates as well. Neither the franchisee nor their sales associates can decline or opt out of providing any office listing to Remax, again unless the client directs otherwise.
Franchisees must provide these office listings in the format and timeframe specified by Remax, utilizing any designated software or platform for managing and providing these listings.
Remax is granted a non-exclusive, irrevocable, perpetual, worldwide, royalty-free license to use, sublicense, copy, publish, display, reproduce, and create derivative works from the listing content. This license applies to all data and content within the office listings, including photographs, images, graphics, video recordings, virtual tours, written descriptions, remarks, narratives, and pricing information. The license is effective from the moment of creation, regardless of whether the franchisee or their sales associate directly provides the listing content or if Remax obtains it from another source.
