Before a Remax office opens, will RE/MAX Regional or REMAX, LLC provide assistance to the franchisee?

FRANCHISOR'S ASSISTANCE, ADVERTISING, COMPUTER SYSTEMS, AND TRAINING

Except as listed below, neither REMAX, LLC nor RE/MAX Regional are required to provide you with any assistance.

Before you open the Office, RE/MAX Regional or REMAX, LLC will:

    1. At your request, assist you in selecting the Office's location which must be approved by RE/MAX Regional. (Franchise Agreement - Subsections 2.A. and 2.C.) RE/MAX Regional's criteria for a location include population density, the number of competing real estate offices in the surrounding area, your financial capability to maintain the Office at the particular location, public access to the Office, parking availability, the location's public appeal and professional image and the proximity to other RE/MAX offices. You may not begin operating the Office until a location has been selected and approved. We will respond to your location request within 30 days after you submit it. If you and RE/MAX Regional, acting reasonably and in good faith, cannot agree on a location for the Office within 90 days after the Franchise Agreement is signed, unless otherwise agreed, it will be deemed to be a failure of a material condition precedent to the Franchise Agreement entitling RE/MAX Regional to terminate the Franchise Agreement. Failure to open the Office within 180 days after the Franchise Agreement is signed will also be deemed to be a failure of a material condition precedent to the Franchise Agreement entitling RE/MAX Regional to terminate the Franchise Agreement. Your initial franchise fee is not refundable if you fail to locate an acceptable site for your Office or you do not open your Office within 180 days after the Franchise Agreement is signed. RE/MAX Regional does not own the premises upon which the Office is located and therefore does not lease it to you.
    1. Furnish you with specifications for the Office's appearance. (Franchise Agreement Subsections 8.A. and 9.B.)
    1. As discussed in Item 8, identify the items necessary for the Office to begin operations, the minimum standards and specifications that must be satisfied and the suppliers from whom these items may be obtained. (Franchise Agreement - Section 3 and Subsections 8.B., 8.K. and 9.B.)
    1. Issue you one or more copies of the Office Materials, which materials may be modified periodically to protect or maintain the goodwill associated with the Marks.

According to Remax's 2025 Franchise Disclosure Document, RE/MAX Regional or REMAX, LLC will provide certain assistance to franchisees before they open their office. Specifically, Remax will assist franchisees in selecting the office location, which must be approved by RE/MAX Regional. The criteria for location approval includes population density, the number of competing real estate offices, the franchisee's financial capability, public access, parking availability, public appeal, professional image, and proximity to other Remax offices. Franchisees cannot begin operating until the location is approved.

Remax also furnishes franchisees with specifications for the office's appearance. Additionally, the franchisee or their principal owner will be provided with an approximately 4-day mandatory initial education program at Remax's headquarters in Denver, Colorado. This also includes up to three 90-minute mandatory coaching calls spaced over the 3 months following attendance of the in-person portion of the Initial Education Program. Remax may offer the in-person portion of the Initial Education Program virtually in the event of inclement weather or a national emergency.

It is important to note that if the franchisee and RE/MAX Regional cannot agree on a location within 90 days after signing the Franchise Agreement, RE/MAX Regional can terminate the agreement, unless otherwise agreed. Similarly, failure to open the office within 180 days after signing the Franchise Agreement can also lead to termination. In such cases, the initial franchise fee is not refundable. This highlights the importance of securing an acceptable site and opening the office within the specified timeframes to avoid potential financial losses and termination of the franchise agreement.
