What This Means (2025 FDD)

According to Remax's 2025 Franchise Disclosure Document, franchisees are required to purchase and use QuickBooks Online by Intuit in order to utilize the Back Office Software. As part of this, franchisees must enter into a QuickBooks Online User Agreement with Intuit. This agreement governs the terms of use for QuickBooks Online.

The QuickBooks Online User Agreement includes several key provisions. It mandates that franchisees comply with all applicable laws while using the software. It also limits Intuit's liability to the franchisee in case of any issues or damages arising from the use of QuickBooks Online. Furthermore, the agreement stipulates that the franchisee must indemnify and hold Intuit harmless for any violation of the terms of use, including any claims or damages resulting from unlawful or unauthorized use of the QuickBooks Online platform.

Importantly, the QuickBooks Online User Agreement provides that Intuit has the right to amend the user agreement at any time. This means that Intuit can modify the terms and conditions of the agreement, and these changes will apply to Remax franchisees using QuickBooks Online. The FDD does not specify how Intuit would notify franchisees of these changes or what recourse a franchisee would have if they disagree with the amendments. Prospective franchisees should carefully review the QuickBooks Online User Agreement and consider the implications of Intuit's right to amend the agreement at any time.
