Is a Remax franchisee limited to operating their office only at the approved location?

Remax Franchise · 2025 FDD

Answer from 2025 FDD Document

You may operate your Office only at the approved location. However, you are not limited by RE/MAX Regional to listing, selling, purchasing, exchanging, or managing property or representing clients or customers within any defined geographic area. Subject to any restrictions or limitations placed upon you by state licensing laws and subject to best business practices, standards and guidelines from time to time issued by RE/MAX Regional and/or REMAX, LLC, you are free to deal with property and/or represent clients and customers wherever they are located. Similarly, other franchisees are free to deal with property and/or represent clients and customers that are located near you.

What This Means (2025 FDD)

According to Remax's 2025 Franchise Disclosure Document, a franchisee may operate their office only at the approved location. The franchisee must first get the location approved by REMAX, LLC. The franchisee may not relocate the office without prior written consent from REMAX, LLC.

Although the franchisee is restricted to the approved location for operating the office, neither the franchisee nor any other Remax office is limited to a defined geographic area for listing, selling, purchasing, or otherwise dealing with property or representing clients or customers, unless restricted by licensing laws and regulations. However, Remax expects high standards of real estate service and professionalism, which may require franchisees to focus on market areas where they can directly and personally serve clients and have knowledge of local conditions.

Remax retains all rights not specifically granted to the franchisee in the agreement. Remax, LLC, or its affiliates may establish other franchised or company-owned outlets at any location, even in close proximity to the franchisee's office, and these outlets may compete with the franchisee's location. Remax, LLC also reserves the right to use alternative distribution methods, including the Internet, in any location, without compensating the franchisee.
