What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, if a Remax franchisee or their sales associates choose to advertise commission rates or fees, the advertisement must include a specific disclaimer. This disclaimer must be in a typeface at least one-half the size of the largest typeface used in the advertisement to specify the commission rates or fees being offered. The required notice states: "Different commission rates, fees and services may be offered by other RE/MAX franchisees and sales associates serving this market area. Commissions are negotiable and not set by law."
This requirement ensures that consumers are aware that commission rates are not uniform across all Remax offices and agents, and that these rates are negotiable. It aims to prevent misleading advertising that could suggest a fixed or standard commission structure. The franchisee is responsible for ensuring that potential clients understand the services they will receive in return for the advertised commission rates or fees.
For a prospective Remax franchisee, this means carefully managing advertising to comply with this disclosure rule. Failure to adhere to the font size requirement or to include the disclaimer could result in violations and potential penalties from Remax. It is crucial to work closely with sales associates to ensure their advertising also meets these standards. This policy reflects the importance of transparency and ethical advertising practices within the Remax franchise system.
