According to Remax's 2025 Franchise Disclosure Document, the Burnett Action, officially titled Scott and Rhonda Burnett, Ryan Hendrickson, Jerod Breit, Scott Trupiano, and Jeremy Keel v. The National Association of Realtors, Realogy Holdings Corp., HomeServices of America, Inc., BHH Affiliates, LLC, HSF Affiliates, LLC, RE/MAX, LLC, and Keller Williams Realty, Inc., was filed on April 29, 2019. The case was pending in the United States District Court for the Western District of Missouri.
The Burnett Action is related to Moehrl-related antitrust litigations. The court granted the plaintiffs' motion for class certification on April 22, 2022, and a trial date was set for October 2023. However, Remax entered into a Settlement Term Sheet on September 15, 2023, to resolve the Burnett Action and Moehrl Action.
The proposed settlement included Remax making certain changes to its business practices and paying a total settlement amount of $55 million. The settlement aimed to resolve all claims set forth in the Burnett Action and Moehrl Action, as well as all similar claims on a nationwide basis against Remax, LLC. This would release Remax and its related entities from these nationwide claims.
