What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, Remax customers are responsible for all use of the Offerings by their Authorized Users. Specifically, customers may permit any Authorized Users to access and use the Offerings as contemplated by the Agreement. User IDs and other access credentials cannot be shared or used by more than one Authorized User at a time.
This means that Remax franchisees who are customers are liable for the actions of anyone they authorize to use Remax's services and platforms. It is the franchisee's responsibility to ensure that their authorized users comply with the terms of the agreement and do not misuse the system. This responsibility extends to safeguarding user IDs and access credentials to prevent unauthorized access.
This clause highlights the importance of carefully managing authorized users and their access to Remax's offerings. Franchisees should implement internal policies and training programs to ensure that all authorized users understand and comply with the terms of use. Failure to adequately manage authorized users could expose the franchisee to liability for their actions.
