What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, Remax Regional has the authority to waive the fulfillment of certain conditions within the franchise agreement. This is explicitly stated in the context of transferring or assigning the franchise.
Specifically, when a franchisee seeks to transfer their franchise to a new owner, Remax may impose several conditions that must be met. These conditions range from ensuring the franchisee is in compliance with all agreements, to requiring the transferee to meet Remax's standards for new franchisees. However, Remax retains the discretion to waive any of these conditions.
This waiver provision provides Remax with flexibility in approving franchise transfers. It allows them to consider the specific circumstances of each transfer and to potentially expedite the process if they deem it appropriate. However, it also means that a franchisee cannot automatically assume that a particular condition will be waived, as the decision rests solely with Remax.
