Besides the Brand Standards Manual, what other requirements and limitations apply to a Remax franchisee's use of the RE/MAX Marks?

Your Limited License to use the RE/MAX Marks is subject to various limitations that are designed to protect the RE/MAX Marks, the goodwill they reflect and the reputation of the RE/MAX Network. In addition to those set forth in the Brand Standards Manual, your use of the RE/MAX Marks must conform to the following requirements and limitations.
(1) Identity of Office, Address and Contact Information Required with RE/MAX Marks.
You agree that all uses of the RE/MAX Marks in all advertising of your services in any medium whatsoever, including but not limited to print, electronic media, social media, and Internet websites, will be accompanied by your Office name, Office address, phone number and prominently indicate that "Each Office Independently Owned and Operated," and to ensure that your Sales Associates also accompany their uses of the RE/MAX Marks with such information and meet all other requirements of the Brand Standards Manual in their advertising and personal promotion efforts. More specifically, you agree not to use, and not to permit your Sales Associates to use, the RE/MAX Marks (a) in any manner that may mislead or deceive consumers in any way, including with respect to your Office location, the scope of the geographic area your Office serves or your relationship to us or REMAX, LLC; or (b) other than for the promotion of the Permitted Real Estate Service Activities provided by your Office. Unless otherwise expressly permitted in the Brand Standards Manual, you agree to refrain from sharing or linking any website, webpage or social media account in connection with which your Office name or the RE/MAX Marks are used with or to any website, webpage
or social media account of a competitor of the RE/MAX Network or from promoting the name, image or business of any licensed real estate agent who is not a RE/MAX Affiliate.

What This Means (2025 FDD)
According to Remax's 2025 Franchise Disclosure Document, in addition to the Brand Standards Manual, several requirements and limitations govern a franchisee's use of the RE/MAX Marks. All advertising of services in any medium must include the office name, address, and phone number, along with the statement "Each Office Independently Owned and Operated." Sales associates must also include this information in their advertising and promotional efforts. Franchisees must not use the RE/MAX Marks in any way that could mislead consumers about the office location, service area, or relationship with Remax, LLC.
Furthermore, the RE/MAX Marks can only be used to promote Permitted Real Estate Service Activities provided by the office. Unless expressly permitted in the Brand Standards Manual, franchisees cannot share or link websites or social media accounts using the RE/MAX Marks to competitors or promote non-RE/MAX licensed real estate agents. Franchisees must also adhere to high standards of service and professionalism, ensuring that all activities under the RE/MAX Marks meet these standards and comply with advertising and marketing laws.
Remax also requires that franchisees use and display the RE/MAX Marks in the style and graphic manner illustrated in the Brand Standards Manual, including proper notices of federal trademark and service mark registrations. Franchisees are prohibited from using any RE/MAX Mark with prefixes, suffixes, or other modifications, and must maintain a consistent size and prominence of the "RE/MAX" portion of their office name in relation to other terms.
Finally, Remax retains the right to direct franchisees to modify or discontinue the use of any RE/MAX Mark, or to use additional or substitute marks, at the franchisee's expense. Franchisees are also prohibited from disparaging the RE/MAX brand or organization. These measures are designed to protect the goodwill and reputation associated with the RE/MAX Marks and the RE/MAX Network.
