What agreement is NOT superseded, replaced, amended, or modified by the agreement described in this section for Remax franchisees?

According to Remax's 2025 Franchise Disclosure Document, the franchise agreement supersedes any previous franchise agreements entered into between RE/MAX Regional and the franchisee. This means that upon signing the new franchise agreement, any prior agreements are replaced. However, this does not apply to any monies that may be due and owing to RE/MAX Regional at the time of renewal.

Specifically, RE/MAX Regional and the franchisee agree to release and forever discharge each other from any and all claims, disputes, damages or liabilities, and causes of action of any kind or nature, arising out of any previous franchise agreements entered into between them. This mutual release is conditional upon the franchisee fulfilling all outstanding financial obligations to RE/MAX Regional.

In practical terms, a Remax franchisee should ensure all financial obligations are settled when renewing their franchise agreement to take full advantage of the release from past liabilities. Failure to settle outstanding debts could leave the franchisee vulnerable to claims arising from previous agreements, despite the new agreement being in place.
