What This Means (2024 FDD)
According to Red Wagon Club's 2024 Franchise Disclosure Document, if you operate your franchise as a corporation, limited liability company, or general or limited partnership, your owners must guarantee your obligations under the Franchise Agreement. This means they are personally liable for the business's debts and responsibilities to Red Wagon Club.
Specifically, the FDD states that each owner's spouse will also be required to sign the guaranty. This spousal signature serves as consent to the owner's execution of the guaranty, acknowledging that the spouse is aware of and agrees to the financial obligations being undertaken.
This requirement is fairly common in franchising, as franchisors seek to ensure that all available assets are accessible should the franchisee default on their obligations. By requiring a spousal guarantee, Red Wagon Club aims to protect its interests and ensure a more secure financial commitment from its franchisees.
