Can Red Wagon Club require me to discontinue using a Mark?

The Marks may evolve over time, including after you sign the Franchise Agreement, as we evaluate the best way to promote the System. If we decide to modify, substitute, add or discontinue the use of any Marks for the System, we may at any time require you to modify, substitute, add, or discontinue using any Mark and/or use one or more additional or substitute Marks. You must replace the Marks at your RWC Business with the modified, additional or substitute Marks we specify and comply with all other directions we give regarding the Marks at your RWC Business within a reasonable time after receiving notice from us. We are not required to reimburse you for any costs or expenses associated with making changes or promoting a modified or substitute Mark, or for any loss of revenue due to any modified or discontinued Mark.

What This Means (2024 FDD)
According to Red Wagon Club's 2024 Franchise Disclosure Document, Red Wagon Club has the right to require franchisees to modify, substitute, add, or discontinue the use of any of its Marks. This decision can be made at any time as Red Wagon Club evaluates the best way to promote its system.
If Red Wagon Club decides to make changes to its Marks, franchisees must replace the existing Marks at their Red Wagon Club business with the modified, additional, or substitute Marks specified by Red Wagon Club. Franchisees must also comply with all other directions given by Red Wagon Club regarding the Marks within a reasonable time after receiving notice.
It is important to note that Red Wagon Club is not required to reimburse franchisees for any costs or expenses associated with making these changes or promoting a modified or substitute Mark. Additionally, Red Wagon Club is not responsible for any loss of revenue that may result from a modified or discontinued Mark. This means that franchisees bear the financial risk of rebranding or adapting to new Marks, which is a fairly common practice in franchising as brands evolve.
