Your RWC Business will operate under the "Red Wagon Club" service mark and other trademarks, service marks, logos, and commercial symbols that we periodically authorize (the "Marks") at a location approved by us (the "Office"). What This Means (2024 FDD)
According to Red Wagon Club's 2024 Franchise Disclosure Document, the term "Marks" refers to the trademarks, service marks, logos, and commercial symbols that Red Wagon Club authorizes for use by its franchisees. As a Red Wagon Club franchisee, your RWC Business will operate under the "Red Wagon Club" service mark and other trademarks, service marks, logos and commercial symbols. These marks are essential for identifying and distinguishing the services offered by Red Wagon Club. The franchisor, Red Wagon Club Franchise, LLC, has an affiliate, Red Wagon Club IP, LLC, that owns the Marks and licenses them to the franchisor, who then sublicenses them to the franchisees.
These Marks, along with the business formats, business system, methods, procedures, signs, designs, layouts, standards, and specifications, collectively form the "System" that franchisees must adhere to. Red Wagon Club retains the right to periodically improve, further develop, or otherwise modify this System, including the Marks. This means that franchisees must stay updated with any changes to the branding and operational standards dictated by Red Wagon Club.
For a prospective franchisee, understanding the scope and importance of the Marks is crucial. It highlights the importance of adhering to the franchisor's branding and operational guidelines to maintain consistency across all Red Wagon Club locations. It also implies that franchisees do not have the freedom to create their own branding or marketing materials that deviate from the approved Marks. Franchisees should seek clarification on how the Marks can be used in their marketing efforts and what restrictions apply.
