What This Means (2024 FDD)

According to the 2024 Red Wagon Club Franchise Disclosure Document, the release provided by a franchisee extends to their successors, heirs, executors, administrators, personal representatives, agents, assigns, partners, owners, managers, directors, officers, principals, employees, and affiliated entities, collectively referred to as the "Releasing Parties."

This means that not only the franchisee but also these related parties are bound by the terms of the release, preventing them from pursuing any claims against Red Wagon Club and its related parties (the "Released Parties"). The release covers a broad range of claims, including those known or unknown, arising from the Franchise Agreement or the relationship between the franchisee and Red Wagon Club.

Furthermore, the franchisee agrees to not allow any of the Releasing Parties to sue Red Wagon Club. This is a significant legal commitment, and prospective franchisees should fully understand its implications, including consulting with legal counsel, before signing the release. The FDD also includes an acknowledgment of California Civil Code Section 1542, which pertains to the release of unknown claims, reinforcing the comprehensive nature of the release.
