Answer from 2024 FDD Document

All fees are imposed by and payable to us, except as otherwise noted in the table, are nonrefundable and fully earned by us upon receipt. Unless otherwise noted, we uniformly impose the fees described in the table. You must make all payments due us or our affiliates in the manner we designate, and you must authorize us and/or any third party we designate to debit your Business Account (as defined below) automatically for any or all amounts due to us or our affiliates by signing an Electronic Funds Transfer Authorization (the "EFT Authorization"), which is attached as Attachment C to the Franchise Agreement. Such EFT Authorization shall remain in full force and effect during the term of the Franchise Agreement. You must ensure that funds are readily available in your Business Account to cover our withdrawals.

What This Means (2024 FDD)

According to Red Wagon Club's 2024 Franchise Disclosure Document, all fees are generally considered fully earned upon receipt and are nonrefundable. This policy applies to most fees payable to Red Wagon Club, unless explicitly stated otherwise. Franchisees are obligated to make payments in the manner designated by Red Wagon Club, which includes authorizing electronic fund transfers from their business account. This authorization remains effective throughout the term of the Franchise Agreement. Franchisees must ensure sufficient funds are available in their business account to cover these withdrawals.

This 'earned upon receipt' policy is a standard practice in franchising. It means that once Red Wagon Club receives a payment, it is considered earned and is nonrefundable, regardless of whether the franchisee fully benefits from the services or programs associated with that fee. This is a crucial point for prospective franchisees to understand, as it affects their financial planning and risk assessment.

For example, the Program Fee, which starts at $2,500 per month and increases to $7,500, is nonrefundable once paid. Similarly, if Red Wagon Club establishes a Brand Fund with anticipated contributions of $500 per month, those contributions would also be nonrefundable upon receipt. Even fees for additional training, which are $1,000 per day plus expenses, are considered earned by Red Wagon Club once paid.

Given this policy, prospective Red Wagon Club franchisees should carefully evaluate their ability to meet the ongoing financial obligations and understand the terms and conditions attached to each fee. It is advisable to seek clarification from Red Wagon Club regarding any specific circumstances or potential exceptions to this general rule.
