Under what circumstances might My Salon Suite define a Nonstandard Territory?

My_Salon_Suite Franchise · 2025 FDD

Answer from 2025 FDD Document

In certain densely populated metropolitan areas or sparsely populated rural areas, a territory may be considerably smaller or larger ("Nonstandard Territory"). We reserve the right to modify the Non-Standard Territory. We will confirm the size of the Protected Territory when we approve the Approved Location. The Protected Territory for a Conversion Franchise will be a defined area as determined by us. The Protected Territory will be based on the sales of the existing business and the size of the market. The population may be less for a Conversion Franchise's Protected Territory than the population for a New Location.

What This Means (2025 FDD)

According to My Salon Suite's 2025 Franchise Disclosure Document, a Nonstandard Territory may be defined in certain circumstances. The standard Protected Territory is typically a radius of 2 miles from the front door of the franchised business. However, My Salon Suite may elect to narrow and/or expand the boundaries of the Protected Territory prior to the franchisee signing a lease on a specific site. These boundaries may be described in terms of zip codes, streets, landmarks, and state or county lines, which may result in a Protected Territory that is larger or smaller than the 2 mile radius.

Specifically, My Salon Suite may define a territory as a Nonstandard Territory in densely populated metropolitan areas or sparsely populated rural areas. The franchisor reserves the right to modify the Non-Standard Territory. The size of the Protected Territory will be confirmed when My Salon Suite approves the Approved Location.

For a Conversion Franchise, the Protected Territory will be a defined area as determined by My Salon Suite, based on the sales of the existing business and the size of the market. The population may be less for a Conversion Franchise's Protected Territory than the population for a New Location. This means that franchisees acquiring an existing My Salon Suite location may have different territorial rights than those opening a new location.
