What is the 'Site Selection Area' for a My Salon Suite franchise?

At the time the parties entered into the Franchise Agreement, Franchisee had not obtained and secured a lease for a location from which to operate a Franchised Business granted under the Franchise Agreement (the "Franchised Business") that Franchisor approved in writing (the "Approved Location").
Within nine (9) months after Franchisee's execution of the Franchise Agreement, Franchisee must purchase or lease an Approved Location, at Franchisee's expense, that Franchisor approves in accordance with the site selection procedure set forth in Sections 2.B. and 7 of the Franchise Agreement.

What This Means (2025 FDD)
According to My Salon Suite's 2025 Franchise Disclosure Document, the 'Site Selection Area' is a geographical search area defined in the Site Selection Addendum (Attachment B to the Franchise Agreement). If a franchisee has not secured an Approved Location prior to the Effective Date of the agreement, they must locate and secure one within this Site Selection Area.
It is important to note that the Site Selection Area is non-exclusive and does not provide the franchisee with any territorial protection. Territorial protection is only granted after an Approved Location has been secured and approved by My Salon Suite. Furthermore, if a franchisee is considering a location within an area where an existing My Salon Suite franchise operates, the proposed location may be subject to a right of first refusal by the existing franchisee.
In cases where the franchisee had not obtained a lease for an approved location when the Franchise Agreement was signed, they have nine months to secure an Approved Location within the Site Selection Area. The franchisee bears the expense of purchasing or leasing this location, and it must be approved by My Salon Suite according to the site selection procedures outlined in the Franchise Agreement.
