Any required standards exist to protect Franchisor's interests in the System and the Marks and not for the purpose of establishing any control or duty to take control over those matters that are reserved to Franchisee.

The required standards generally will be set forth in the Manual or other written materials.

The Manual also will include guidelines or recommendations in addition to required standards.

In some instances, the required standards will include recommendations or guidelines to meet the required standards.

Franchisee may follow the recommendations or guidelines or some other suitable alternative, provided Franchisee meets and complies with the required standards.

In other instances, no suitable alternative may exist.

To protect Franchisor's interests in the System and Marks, Franchisor reserves the right to determine if Franchisee is meeting a required standard and whether an alternative is suitable to any recommendations or guidelines.

The Manual is to protect and maintain the System Standards and the Proprietary Marks and not to control the day-to-day operation of Franchisee's Franchised Business.

Franchisee must sign a Training and Joint Employer Acknowledgment to indicate Franchisee's understanding of this.

This acknowledgment will be in the form contained as Attachment F to this Franchise Agreement.

According to the 2025 My Salon Suite Franchise Disclosure Document, My Salon Suite's role as franchisor is to develop, use, and control the Proprietary Marks to identify the source of services and products marketed under the System. My Salon Suite aims to represent the System's standards of quality, appearance, and service. The franchisor also maintains the System Standards and the Proprietary Marks. My Salon Suite provides the My Salon Suite University training program to protect and maintain the System Standards and the Proprietary Marks.

My Salon Suite sets required standards to protect its interests in the System and the Marks, but does not intend to control the franchisee's day-to-day operations. These standards are typically outlined in the Manual or other written materials, which may include guidelines or recommendations. My Salon Suite retains the right to determine if a franchisee is meeting the required standards and whether any alternative approaches are suitable.

The franchisee, on the other hand, is responsible for the day-to-day operations of the Franchised Business, compliance with all applicable laws, and maintaining required permits, licenses, and registrations. The franchisee must also maintain the confidentiality of My Salon Suite's proprietary and confidential information and operate the Franchised Business in a manner that enhances the image intended for the System. The franchisee must use only approved displays, bags, labels, forms, stationery, and other products bearing the Proprietary Marks.
