What This Means (2025 FDD)
According to the 2025 FDD, the My Salon Suite manual serves to protect and maintain the System Standards and Proprietary Marks, rather than controlling the day-to-day operations of the franchised business. The standards outlined in the manual are designed to protect My Salon Suite's interests in its system and marks, without infringing on the franchisee's autonomy over their business operations.
The manual includes both required standards and guidelines or recommendations. Franchisees have the option to follow these recommendations or implement suitable alternatives, as long as they meet the required standards. However, in some cases, no alternative may exist, and franchisees must adhere strictly to the manual's guidelines. My Salon Suite retains the right to assess whether a franchisee is meeting the required standards and whether any alternative approaches are suitable.
Franchisees must acknowledge their understanding of the manual's purpose by signing a Training and Joint Employer Acknowledgment, included as Attachment F to the Franchise Agreement. This ensures that franchisees recognize the distinction between maintaining brand standards and controlling daily business activities. This acknowledgment highlights the importance of franchisees understanding their role in upholding the My Salon Suite system while managing their own operations.
