Who owns the My Salon Suite trademark?

According to My Salon Suite's 2025 Franchise Disclosure Document, the My Salon Suite trademark is owned by the franchisor. My Salon Suite has a registration with the United States Patent and Trademark Office (USPTO) for the My Salon Suite mark.

My Salon Suite grants franchisees the right to operate their franchised business under all applicable marks and any other trade names, trademarks, service marks, and logos currently used or that may be used in the future. Franchisees must comply with My Salon Suite's standards, specifications, rules, requirements, and instructions regarding the use of the marks. The goodwill associated with the marks remains the exclusive property of My Salon Suite, and franchisees receive no tangible benefit from this goodwill, except from the operation or possible sale of the franchised business during the term of the Franchise Agreement. Any increase in the goodwill associated with the marks during the term of the Franchise Agreement will benefit My Salon Suite.

Upon expiration or termination of the Franchise Agreement, all rights to use My Salon Suite's marks automatically revert to them without cost or the need for any documentation. Franchisees are prohibited from using any portion of the marks as part of their company name and, without prior written consent, as part of their trade name or "d/b/a." Franchisees may not modify the marks with unauthorized words, designs, or symbols or use the marks in connection with the sale of unauthorized products or services. Franchisees must indicate in contracts, advertisements, and with a conspicuous sign that they are independently owned and operated licensed franchisees of SMF.

During and after the term of the Franchise Agreement, franchisees and their managers cannot contest or challenge My Salon Suite's rights to the marks, trade secrets, methods, procedures, and advertising techniques that are part of the franchise system. They also cannot contest My Salon Suite's sole right to register, use, or license others to use the marks, trade secrets, methods, procedures, advertising techniques, and any other mark or name that incorporates the words "My Salon Suite" or any similar phrase.
