What This Means (2025 FDD)
According to the 2025 My Salon Suite Franchise Disclosure Document, the term "Marks" encompasses the "My Salon Suite" trademark, along with other trademarks, trade names, service marks, and logos that My Salon Suite designates for its businesses. This definition extends to include any distinctive trade dress used to identify a My Salon Suite business, regardless of whether it currently exists or is created in the future.
For a prospective franchisee, this means that the branding elements they are authorized to use under the franchise agreement are quite broad. It is not just the primary "My Salon Suite" trademark, but also any other visual or verbal identifiers that the company uses to distinguish its businesses. This could include specific color schemes, building designs, or even taglines.
The inclusion of "any distinctive trade dress" is particularly important. Trade dress refers to the overall look and feel of a business, which can include everything from the layout of the salon suites to the design of marketing materials. This means that My Salon Suite has significant control over how franchisees present their businesses to the public, ensuring a consistent brand image across all locations. Franchisees must adhere to these standards to maintain the integrity of the brand and avoid any potential legal issues related to trademark infringement.
By franchising with My Salon Suite, franchisees gain the right to operate under these protected Marks, benefiting from the brand recognition and goodwill associated with them. However, it also means they are obligated to use these Marks in accordance with My Salon Suite's guidelines and standards, as outlined in the franchise agreement.
