What This Means (2025 FDD)
According to My Salon Suite's 2025 Franchise Disclosure Document, details regarding the renewal of a franchise agreement can be found in Section 4.B of the Franchise Agreement. A franchisee in good standing who meets specific requirements has the option to enter into two consecutive renewal terms, each lasting 10 years.
To renew the franchise, the franchisee must provide notice of their intent to renew no less than 9 months and no more than one year before the end of the current term. They must also demonstrate that they have the right to continue operating the Franchised Business at the approved location for the renewal term. If the franchisee cannot continue at the current location, they must secure a substitute location acceptable to My Salon Suite. The franchisee is responsible for completing all necessary maintenance, refurbishing, renovations, updates, and remodeling of the premises to comply with the then-current standards for new franchisees, including hardware and software updates.
Furthermore, the franchisee must not be in breach of the Franchise Agreement or any other agreements with My Salon Suite, its affiliates, or approved vendors, and must be in substantial compliance with these agreements. All monetary obligations to My Salon Suite, its affiliates, and approved vendors must be satisfied. The franchisee must also execute the then-current form of the franchise agreement, which may contain materially different terms and conditions, including potentially higher royalty fees and brand building fund contributions, compared to the original agreement. The franchisee is also required to meet the then-current training requirements for renewing franchisees at their own expense and execute a general release in favor of My Salon Suite and its affiliates. Finally, the franchisee must pay a renewal franchise fee equal to 15% of My Salon Suite's then-current initial franchise fee for a Franchised Business.
