Answer from 2025 FDD Document

In deciding whether to approve a site, we may also consider, among other things: (i) demographic characteristics, traffic patterns, allowed design and building, parking, visibility, allowed signage, the predominant character of the neighborhood surrounding the proposed site; (ii) competition from other businesses selling similar products and services within the area, and the proximity of the site to these businesses, as well as the nature of all other businesses in proximity to the site; (iii) zoning restrictions, soil and environmental issues, and other commercial characteristics; and (iv) the size, appearance, and other physical characteristics of the proposed site (Section 7.1 of the Franchise Agreement).

You must submit information and materials for at least one (1) proposed site to us for approval no later than six (6) months after you have signed your Franchise Agreement.

We will have 15 business days after we receive this information and materials from you to approve or disapprove the proposed site as the location for the Franchised Business.

If we do not provide our specific approval of a proposed site, the site is deemed not approved.

Our approval only means that the site meets our minimum requirements for a Franchised Business.

Before you lease or purchase the site for the Franchised Business, you must locate a site that satisfies our site selection guidelines (Sections 7.A through 7.E of the Franchise Agreement).

If we determine that an on- site evaluation is necessary, then you must: (i) submit to us in the form we specify a description of the site prior to our representative conducting its on-site evaluation, including evidence that the site satisfies our site selection guidelines, together with other information and materials that we may reasonably require, including a letter of intent or other evidence that confirms your favorable prospects for obtaining the site; and (ii) reimburse us for the expenses incurred in connection with such an evaluation.

What This Means (2025 FDD)

According to My Salon Suite's 2025 Franchise Disclosure Document, the company considers several factors when determining whether to approve a site for a new franchise location. Franchisees are required to conduct an evaluation of the demographics of the market area for their proposed location, at their own expense. My Salon Suite may use this information to determine if the site is suitable.

In addition to demographic data, My Salon Suite may consider factors such as traffic patterns, allowed design and building types, parking availability, visibility, allowed signage, and the general character of the surrounding neighborhood. They also assess the competitive landscape, including the presence of similar businesses in the area and the nature of other businesses nearby. Zoning restrictions, potential soil and environmental issues, and other commercial characteristics are also taken into account.

The physical characteristics of the proposed site, including its size and appearance, are also important considerations for My Salon Suite. The company's approval indicates that the site meets their minimum requirements, but franchisees must ensure the site aligns with My Salon Suite's site selection guidelines before leasing or purchasing it. Franchisees need to submit site information within six months of signing the Franchise Agreement, and My Salon Suite has 15 business days to review and respond. If My Salon Suite does not explicitly approve a site, it is considered disapproved.

If an on-site evaluation is deemed necessary, the franchisee must provide a detailed description of the site, evidence that it meets My Salon Suite's guidelines, and a letter of intent or similar confirmation of favorable prospects for securing the site. The franchisee is also responsible for reimbursing My Salon Suite for any expenses incurred during the on-site evaluation. Securing site approval is a critical step, as My Salon Suite may terminate the Franchise Agreement if a suitable location is not proposed within six months or secured (including a signed lease) within nine months of signing the agreement.
