What This Means (2025 FDD)
According to Gold Star's 2025 Franchise Disclosure Document, Gold Star has broad rights to utilize data from a franchisee's Communication and Information System. Gold Star can use any data collected or provided by the franchisee that is downloaded from the Communication and Information System, or otherwise collected from the franchisee's system, in any manner it deems appropriate for the operation of the Gold Star system. This includes using the data without providing any compensation to the franchisee.
Specifically, Gold Star can disclose or distribute this information to other Gold Star franchisees. This allows Gold Star to share best practices, performance metrics, or other operational insights across the franchise network. Gold Star can also disclose this information to prospective franchisees, potentially including it in the franchise disclosure document or other materials provided to them. This could give potential franchisees insights into the performance and operations of existing locations.
This clause gives Gold Star significant latitude in how it uses franchisee data, which could be beneficial for system-wide improvements and transparency. However, franchisees should be aware that their operational data will be accessible to Gold Star and potentially shared with other franchisees or prospective franchisees. Franchisees should consider the implications for their own business and competitive advantage, and they may want to discuss with Gold Star how the data will be anonymized or aggregated to protect their specific business information when shared with others.
