What This Means (2025 FDD)
The 2025 Gold Star Franchise Disclosure Document does not specify the exact notice Gold Star must provide a franchisee when transferring the franchise agreement, but it does outline the general requirements for notices. All notices to Gold Star must be in writing and either delivered personally, sent by reputable overnight delivery service, or by certified mail (postage prepaid, return receipt requested), addressed to Gold Star's office in Cincinnati, Ohio, to the attention of the Director of Franchising, or to such other address as Gold Star designates in the Manual or in writing.
Conversely, all notices to the franchisee must be in writing and either delivered personally to an adult person working at the Retail Location, or sent by reputable overnight delivery service, or by regular or certified mail (postage prepaid, return receipt requested), addressed to the franchisee at the franchisee's address set forth on the cover page of the Franchise Agreement, or at such other address as the franchisee designates in writing.
Any notice by certified mail is deemed delivered on the second business day after mailing, while overnight delivery is considered delivered on the first business day after being given to the service. Personal delivery is effective immediately upon delivery.
While the FDD specifies how notices should be delivered, it does not state the specific timeframe or conditions under which Gold Star must notify a franchisee of a transfer. A prospective franchisee should ask Gold Star about the specific notification requirements related to franchise agreement transfers to fully understand their obligations and rights.
