What This Means (2025 FDD)
According to Gold Star's 2025 Franchise Disclosure Document, upon termination or expiration of the franchise agreement, the franchisee's right to use the Gold Star system immediately ceases. All rights, privileges, and licenses granted by Gold Star to the franchisee become null and void and revert back to Gold Star. The franchisee must immediately discontinue using the Gold Star system and marks.
After termination or expiration, the franchisee has 30 days to remove the Gold Star marks from all buildings, signs, fixtures, and furnishings. If Gold Star provides written notice, the franchisee must alter and repaint all structures to a design and color different from Gold Star's authorized design and painting schedule within 30 days of the notice. This ensures a complete de-identification of the business from the Gold Star brand.
If the franchisee fails to remove the marks or alter the structures, Gold Star has the right to enter the retail location and perform the removal, alterations, and repainting at the franchisee's expense. The franchisee is responsible for paying these expenses to Gold Star upon demand. This clause emphasizes the importance of prompt compliance with de-identification requirements to protect Gold Star's brand and system after the franchise agreement ends.
