What This Means (2025 FDD)
According to Gold Star's 2025 Franchise Disclosure Document, the franchisee has sole responsibility for how their Communication and Information System interfaces with other systems. This includes interfaces with Gold Star's systems and those of third parties. The franchisee also bears responsibility for any consequences arising from improper operation, maintenance, or upgrades to the Communication and Information System.
This means that if the franchisee's system isn't properly connected or maintained, leading to issues like data loss or miscommunication with Gold Star or other vendors, the franchisee is liable. This responsibility extends to ensuring the system is up-to-date and functioning correctly to avoid any operational disruptions or compliance issues.
While Gold Star specifies the Communication and Information System that franchisees must use, the franchisee is ultimately accountable for its proper integration and upkeep. This highlights the importance of franchisees ensuring their staff are adequately trained to operate and maintain the system, and that they adhere to Gold Star's standards and guidelines for its use. Franchisees should also ensure they have adequate technical support to address any issues that may arise.
This allocation of responsibility is fairly standard in franchising, where the franchisor sets the system standards but the franchisee manages day-to-day operations and technology implementation at their specific location. However, franchisees should carefully review the required Communication and Information System and ensure they understand the full scope of their responsibilities and potential liabilities.
