What This Means (2025 FDD)
According to Gold Star's 2025 Franchise Disclosure Document, the company can deliver notices to the franchisee through several methods. In addition to personal delivery to an adult at the retail location, Gold Star may send notices via reputable overnight delivery service. Alternatively, Gold Star can use regular or certified mail, with postage prepaid and return receipt requested. The notice should be addressed to the franchisee at the address listed on the cover page of the Franchise Agreement, unless the franchisee has provided a different address in writing.
For the franchisee, this means that Gold Star has multiple avenues for official communication. It is important for the franchisee to ensure that the address on file with Gold Star is current to avoid missing critical notices. Using certified mail with return receipt requested ensures that Gold Star has proof of delivery, which can be important in legal or contractual situations.
The FDD also specifies when a notice is considered delivered. A notice sent by certified mail is deemed delivered on the second business day after it is deposited in the mail. If sent by reputable overnight delivery service, it is considered delivered on the first business day after it is given to the service. Personal delivery is considered effective immediately upon delivery. Franchisees should be aware of these timelines to understand their obligations and deadlines related to any notices received from Gold Star.
