Except with the prior written consent of the Franchisor, the Program shall not be: (i) operated by persons other than the Franchisee and employees of the Franchisee; (ii) operated on more than one computer at a time; (iii) operated on equipment other than the Designated Equipment; or (iv) operated at locations other than the Franchised Location.

The Program shall be used only to perform information processing in the Franchisee's operation of the FLOYD'S 99 Shop and shall not be used to perform information processing for any other person, entity or business.

What This Means (2025 FDD)
According to Floyds 99's 2025 Franchise Disclosure Document, the Floyds 99 Program generally cannot be operated by individuals other than the franchisee and their employees, unless the franchisor provides prior written consent. The program is intended for information processing solely related to the franchisee's Floyds 99 shop operations and not for any other person, entity, or business.
Floyds 99 franchisees are responsible for ensuring the confidentiality and security of the program and any data generated from its use. This includes preventing unauthorized access, use, disclosure, or copying of the program. Franchisees must also ensure that any employees with access to the program sign a written confidentiality agreement approved by Floyds 99.
However, Floyds 99 does retain the right to appoint an interim Principal Manager to operate and manage a franchisee's shop under specific circumstances. This includes situations where the franchisor determines the shop is not being managed properly, is not being operated by someone who completed the initial training program, or if a default occurs. This measure is in place to prevent interruption of operations that could harm the Floyds 99 system. During such times, Floyds 99 will manage the shop's finances, covering expenses and compensating its representatives, and may also charge a management fee in addition to royalties and other fees.
