Is Floyds 99 obligated to provide on-site advice and assistance to franchisees?

Although not obligated to do so, the Franchisor may make its employees or designated agents available to the Franchisee for on-site advice and assistance in connection with the on-going operation of the FLOYD'S 99 Shop governed by this Agreement. If the Franchisee requests such additional assistance and the Franchisor agrees to provide the same, the Franchisor reserves the right to charge the Franchisee for all travel, lodging, living expenses, telephone charges and other identifiable expenses associated with such assistance, plus a fee based on the time spent by each employee on behalf of the Franchisee, which fee will be charged in accordance with the then current daily or hourly rates being charged by the Franchisor for assistance.

What This Means (2025 FDD)
According to the 2025 Floyds 99 Franchise Disclosure Document, Floyds 99 is not obligated to provide on-site advice and assistance to franchisees. However, Floyds 99 may choose to make its employees or agents available for on-site advice and assistance for the ongoing operation of the Floyds 99 shop.
If a franchisee requests this additional assistance and Floyds 99 agrees to provide it, Floyds 99 reserves the right to charge the franchisee for all associated expenses. These expenses include travel, lodging, living expenses, telephone charges, and other identifiable costs.
In addition to covering the expenses, Floyds 99 will also charge a fee based on the time spent by each employee assisting the franchisee. This fee will be determined by the then-current daily or hourly rates that Floyds 99 charges for such assistance. This means franchisees should be prepared to cover these potential costs if they seek and receive on-site support from Floyds 99 beyond the initial setup.
