What This Means (2025 FDD)
According to the 2025 Floyds 99 Franchise Disclosure Document, if a franchisee misuses or fails to follow the franchisor's directions and guidelines concerning the use of Floyds 99's marks, they will be given 10 days after notification from the franchisor to correct the misuse or failure. If the franchisee does not correct the misuse within the given timeframe, it can result in the termination of the franchise agreement.
Floyds 99 maintains strict control over its trademarks and brand identity. Franchisees are required to display the marks prominently at their barbershop premises, on furnishings, packaging, and in all advertising and marketing materials, adhering to the franchisor's specifications. The agreement explicitly states that franchisees do not acquire any right, title, or interest in the marks, except for the right to use them in the operation of their Floyds 99 shop as governed by the franchise agreement.
To protect its brand, Floyds 99 prohibits franchisees from using any service marks other than "FLOYD'S 99" or other marks specified by the franchisor in the identification, marketing, promotion, or operation of the shop. Franchisees are also restricted from using the marks as part of an email address or on internet sites, and they cannot register any of the marks as part of a domain name without the franchisor's explicit permission. These measures ensure that Floyds 99 maintains a consistent brand image and prevents unauthorized use of its intellectual property.
