Answer from 2025 FDD Document

Developer shall not, without the prior written approval of Franchisor, enter into any contract for the purchase or lease of any premises for use as a FLOYD'S 99 Shop. Franchisor will assist Developer in the selection and approval of locations for its Barbershops, although Developer acknowledges that Franchisor has no obligation to select or acquire a location on behalf of Developer. Assistance by Franchisor will consist of the provision of criteria for a satisfactory location and any other assistance set forth in the Franchise Agreement.

What This Means (2025 FDD)

According to the 2025 Floyds 99 Franchise Disclosure Document, while Floyds 99 will assist a developer in the selection and approval of locations for their barbershops, Floyds 99 has no obligation to select or acquire a location on behalf of the developer. This means the responsibility of finding and securing a suitable site rests primarily with the developer, not Floyds 99. Floyds 99's assistance includes providing criteria for what constitutes a satisfactory location.

This arrangement is fairly typical in the franchise industry, where franchisees or developers usually bear the responsibility for site selection. However, franchisors often provide guidance and approval to ensure the location meets brand standards and has the potential for success. For a Floyds 99 developer, this means they need to be proactive in researching and identifying potential locations, understanding local market conditions, and negotiating lease or purchase agreements.

While Floyds 99 offers assistance, the ultimate decision and risk associated with the location lie with the developer. The developer must obtain Floyds 99's prior written approval before entering into any contract for the purchase or lease of premises. This approval process is in place to protect the Floyds 99 brand and ensure that new locations align with the company's overall strategy and standards. Developers may also seek additional assistance from Floyds 99 concerning site selection, site feasibility studies, and lease negotiations, but Floyds 99 may charge the developer for expenses incurred while providing such assistance.
