What This Means (2025 FDD)
According to the 2025 Floyds 99 Franchise Disclosure Document, the franchisee is responsible for obtaining all permits and certifications required for the lawful construction and operation of the Floyds 99 shop. This includes certifications from government authorities confirming that all construction and operation requirements have been met, such as zoning, access, sign, health, and safety requirements, as well as building and other required construction permits, licenses to do business, fictitious name registrations, sales tax permits, local barbering and cosmetology permits and ratings, and fire clearances. The franchisee must also obtain customary contractors' sworn statements and lien waivers for construction and equipment installation.
The franchisee must confirm their compliance with the Americans With Disabilities Act and other construction-related provisions by executing and delivering a Permit, License, and Construction Certification form to Floyds 99 no later than 30 days before the barbershop begins operating. Additionally, the franchisee is required to send a copy of the occupancy certificate to Floyds 99 and keep copies of all relevant certifications, licenses, and inspection reports on file for review by Floyds 99. Within 30 days of opening, the franchisee must also provide Floyds 99 with a copy of their barbershop license or permit, if applicable, along with the contact information for the relevant state and local barbering and cosmetology licensing agencies.
The Floyds 99 Franchise Agreement does not state that Floyds 99 provides any financial assistance or reimbursement to the franchisee for securing the necessary permits, licenses, or construction certifications. Therefore, the franchisee should anticipate covering these costs independently. It is common practice in franchising for franchisees to bear the responsibility for these expenses, as they are directly related to the establishment and operation of their specific location. A prospective franchisee should confirm the estimated costs of these items with the franchisor and local authorities during their due diligence.
