Does Floyds 99 have any Captive Audience Facilities under contract as of the date of the Disclosure Document?

According to the 2025 Floyds 99 Franchise Disclosure Document, as of the date of the document, Floyds 99 does not have any Captive Audience Facilities under contract. However, Floyds 99 retains the right to contract with these facilities in the future. Captive Audience Facilities are defined as locations where people gather for a primary purpose unrelated to a barbershop, but which generate significant foot traffic. Examples of these facilities include airports, hospitals, college campuses, convention centers, grocery stores, department stores, big box retailers, resorts, hotels, and office buildings.

Floyds 99 offers franchisees the first opportunity to develop and operate a barbershop within a Captive Audience Facility that falls within their Protected Territory or Development Area. If such an opportunity arises, Floyds 99 will notify the franchisee, who then has 15 days to decide whether to pursue the location. The franchisee must comply with the terms and conditions that Floyds 99 has negotiated with the Captive Audience Facility.

If the franchisee declines the opportunity, Floyds 99, its affiliates, or another franchisee can develop the location, and the original franchisee forfeits any rights to that specific location during the contract term. This clause ensures that Floyds 99 can capitalize on opportunities in high-traffic areas, even if the local franchisee is unable or unwilling to do so. Prospective franchisees should inquire about the typical terms and conditions of these Captive Audience Facility contracts to better understand the potential obligations and benefits.
