If such an opportunity arises, Floyds 99 will notify the franchisee, who then has 15 days to decide whether to pursue the location. The franchisee must comply with the terms and conditions that Floyds 99 has negotiated with the Captive Audience Facility.

If the franchisee declines the opportunity, Floyds 99, its affiliates, or another franchisee can develop the location, and the original franchisee forfeits any rights to that specific location during the contract term. This clause ensures that Floyds 99 can capitalize on opportunities in high-traffic areas, even if the local franchisee is unable or unwilling to do so.
