9.1 Franchisor's Services. The Franchisor, or its designee, shall, during the Franchisee's operation of the FLOYD'S 99 Shop, make available to the Franchisee the following services:
- a. The Franchisor shall give the Franchisee access to advertising and promotional materials as may be developed by the Franchisor, the cost of which may be passed on to the Franchisee or charged to the National Marketing Fund (defined in Section 13.2 below), at the Franchisor's option.
13.1 Approval of Advertising. The Franchisee shall obtain the Franchisor's prior written approval of all written advertising or other marketing or promotional programs regarding the FLOYD'S 99 Shop, including, without limitation, "Yellow Pages" and other directory listing advertising, newspaper ads, flyers, brochures, magazines, coupons, direct mail pieces, specialty and novelty items and radio, television. See Section 13.6 below regarding electronic advertising. The Franchisee shall also obtain the Franchisor's prior written approval before using any promotional materials as may be provided by vendors. The proposed written advertising or a description of the marketing or promotional program shall be submitted to the Franchisor at least 30 days prior to publication, broadcast or use. The Franchisee acknowledges that advertising and promoting the FLOYD'S 99 Shop in accordance with the Franchisor's standards and specifications is an essential aspect of the Licensed Methods, and the Franchisee agrees to comply with all advertising standards and specifications. The Franchisee shall display all required promotional materials, signs, point of purchase displays and other marketing materials in its FLOYD'S 99 Shop and in the manner prescribed by the Franchisor.
Franchisor shall retain the exclusive right to develop and control the content of all Electronic Advertising for the FLOYD'S 99 Shops.
The Franchisee shall maintain and operate the FLOYD'S 99 Shop in compliance with this Agreement and the standards and specifications contained in the Operations Manual, as the same may be modified from time to time by the Franchisor.
The Franchisor will make available to the Franchisee standards and specifications for products and services offered at or through the FLOYD'S 99 Shop and for the Franchised Location, equipment, furniture, fixtures, hair care products offered for sale, hair care products used, inventory policies, employee attire, supplies, forms, advertising material and other items used in connection with the Barbershop.

According to Floyds 99's 2025 Franchise Disclosure Document, franchisees will have access to advertising and promotional materials developed by the franchisor. The cost for these materials may be passed on to the franchisee or charged to the National Marketing Fund, depending on Floyds 99's discretion.
Floyds 99 also requires franchisees to obtain prior written approval for all written advertising and other marketing or promotional programs. This includes, but is not limited to, "Yellow Pages" and other directory listing advertising, newspaper ads, flyers, brochures, magazines, coupons, direct mail pieces, specialty and novelty items and radio, television. Franchisees must submit proposed advertising materials to Floyds 99 at least 30 days before their intended use.
Floyds 99 maintains exclusive control over all electronic advertising. While franchisees cannot independently develop electronic advertising, they may be required to participate in electronic advertising sponsored by Floyds 99 or to modify their websites and social media content as directed by the franchisor. Floyds 99 also provides standards and specifications for advertising materials, which franchisees must adhere to. Franchisees are also required to display all promotional materials, signs, and point of purchase displays as prescribed by Floyds 99.
