What This Means (2024 FDD)

According to the 2024 Extreme Art Studio Franchise Disclosure Document, Exhibit H-1 outlines a sample release agreement. This agreement is required when a franchisee seeks to transfer their franchise agreement, enter into a successor franchise agreement, amend the existing agreement, or terminate the agreement. The release is a condition of Extreme Art Studio's consent to any of these actions.

Specifically, the release agreement is triggered when a franchisee notifies Extreme Art Studio of their desire to transfer the agreement and its rights, transfer ownership interest, enter a successor franchise agreement, or amend the agreement. It also applies when the franchise agreement is being terminated or for any other reason requiring a waiver and release. Extreme Art Studio's consent to these actions is contingent upon the releasor agreeing to execute the release according to the terms and conditions outlined in the agreement.

In essence, the release agreement serves to protect Extreme Art Studio from potential liabilities or claims that may arise due to changes in the franchise agreement or its termination. By requiring a release, Extreme Art Studio ensures that all parties involved waive any rights to pursue legal action related to the franchise agreement, providing a clean break or transition.
