What This Means (2024 FDD)
According to the 2024 Extreme Art Studio Franchise Disclosure Document, the obligations outlined in Section 5 of the Franchise Agreement do indeed apply to the franchisee's owners. Specifically, Section 5.7, titled 'OWNERS BOUND,' explicitly states that each obligation to take or refrain from specific actions, or to engage or refrain from engaging in specific activities, as detailed in Section 5, applies to each of the franchisee's owners. This means that owners are held to the same standards and requirements as the franchisee regarding the stipulations in Section 5 of the agreement.
This provision ensures that Extreme Art Studio can enforce key operational and brand-related requirements not only on the franchisee entity but also directly on the individuals who own the franchise. This is a common practice in franchising, as it provides an additional layer of accountability and helps maintain consistency across all franchise locations. By binding the owners to these obligations, Extreme Art Studio aims to protect its brand reputation and operational standards.
For a prospective Extreme Art Studio franchisee, this means that if you are an owner, you must be fully aware of and compliant with all the obligations listed in Section 5 of the Franchise Agreement. This includes, but is not limited to, any requirements related to indemnification for the use of marks and non-disparagement. Failing to comply with these obligations could result in a breach of the Franchise Agreement, potentially leading to penalties or even termination of the franchise. Therefore, it is crucial to carefully review and understand Section 5 and its implications for all owners involved in the Extreme Art Studio franchise.
