What This Means (2024 FDD)
According to Extreme Art Studio's 2024 Franchise Disclosure Document, the franchise agreement outlines that certain obligations continue even after the agreement expires or is terminated. Specifically, Section 15.5 states that any obligations that are explicitly stated to survive the termination or expiration, or those that by their nature would survive, remain in full effect.
This means that franchisees must carefully review the franchise agreement to identify which obligations are designed to extend beyond the term of the agreement. These could include, but are not limited to, non-compete clauses, confidentiality agreements, and potentially any obligations related to intellectual property or innovations developed during the franchise term.
For a prospective Extreme Art Studio franchisee, this clause underscores the importance of understanding all post-termination obligations before entering into the agreement. It is advisable to seek legal counsel to fully understand the implications of these continuing obligations and to assess how they might affect the franchisee's future business activities after the franchise term ends.
