What This Means (2024 FDD)

According to Extreme Art Studio's 2024 Franchise Disclosure Document, a franchisee who meets certain conditions has the option to acquire a successor franchise agreement for an additional term of ten years. This allows the franchisee to continue operating their Extreme Art Studio business under the franchise system for another decade, provided they meet the requirements set forth by Extreme Art Studio.

To qualify for a successor franchise, the franchisee must have substantially complied with the existing Franchise Agreement during its original term. They must also be in full compliance with the Franchise Agreement and all System Standards both when they provide written notice of their intent to acquire a successor franchise and on the date the successor franchise term is set to begin. This emphasizes the importance of maintaining a strong operational record and adhering to Extreme Art Studio's standards throughout the franchise term.

In addition to compliance requirements, the franchisee may need to update or replace operating assets at Extreme Art Studio's request to meet current System Standards. They must also pay a successor franchise fee, which is ten percent of the then-current Initial Franchise Fee for new franchises. This fee is compensation to Extreme Art Studio for the continued use of its brand, system, and support. The franchisee must also retain the rights to use the studio location, either by renewing their lease agreement or securing rights to a substitute studio location approved by Extreme Art Studio.

Overall, the option to acquire a successor franchise provides an Extreme Art Studio franchisee with the opportunity to extend their business operations for another ten years, offering long-term stability and continued access to the franchise system. However, franchisees must remain compliant with all requirements and be prepared to invest in updates and fees to secure the successor franchise.
