At least ten days before you intend to use them, you agree to send us for approval samples of all advertising, promotional and marketing materials that we have previously not approved. If we do not approve of the materials within five days of our receipt of such materials, then they shall be deemed disapproved. You may not use any advertising, promotional or marketing materials that we have not approved or have disapproved.

What This Means (2024 FDD)

According to Extreme Art Studio's 2024 Franchise Disclosure Document, a franchisee must submit advertising, promotional, and marketing materials for approval at least ten days before they intend to use them. Extreme Art Studio then has five days to approve or disapprove the submitted materials. If Extreme Art Studio does not respond within that five-day period, the materials are considered disapproved. The franchisee is prohibited from using any advertising, promotional, or marketing materials that have not been approved or have been explicitly disapproved by Extreme Art Studio.

This requirement ensures that all advertising and promotional activities align with Extreme Art Studio's brand standards and ethical guidelines. It allows Extreme Art Studio to maintain consistency and quality across all franchise locations, protecting the brand's reputation. The ten-day submission window, coupled with the five-day review period, provides a structured process for franchisees to develop and implement marketing strategies while adhering to the franchisor's standards.

For a prospective franchisee, this means planning marketing campaigns well in advance to accommodate the approval process. Failure to submit materials in a timely manner or using unapproved materials could result in penalties or other consequences as outlined in the franchise agreement. Franchisees should factor in this review period when creating their marketing calendars and budgets to avoid delays or disruptions in their promotional efforts.

This type of approval process is fairly common in franchising, as it allows the franchisor to maintain brand consistency and ensure that franchisees are not making misleading or inaccurate claims in their advertising. Franchisees should maintain open communication with Extreme Art Studio to understand their specific guidelines and preferences for advertising materials to facilitate a smooth and efficient approval process.
